Former Attorney General (AG) Hassan Ariff yesterday said literally there is nothing called presidential form of government in the constitution.
He said this during an interview with BBC Bangla Service last night following a comment of Chief Adviser Iajuddin Ahmed, who said after taking the responsibility of the caretaker government, the present government has turned into a presidential form of government.
Ariff said according to the constitution, the president works as a titular head. “But as the caretaker chief, the president is now supposed to use the power of a caretaker chief entitled in the constitution.”
He said there is no scope of any conflict when two roles are merged. “If the president and the caretaker chief were different persons, there would be question of differences in opinions,” Ariff told the BBC.
The former attorney general said as caretaker chief, the president’s responsibility is now to assist the Election Commission for holding a free and fair election and also to monitor the routine works.
Former law minister Moudud Ahmed, however, said, “Taking everything into consideration, what he (president) has said is not unconstitutional, rather he spoke in line with the constitution.”
“There is nothing wrong with the presidential form of government. This is an interim arrangement and it has been incorporated in the 13th amendment of the constitution. The source of power is same,” viewed the former law minister.
