The High Court yesterday declared illegal the detention of former lawmaker Salahuddin Quader Chowdhury under the Special Powers Act, 1974.
Passing the verdict upon a habeas corpus petition, a division bench comprising Justice MA Wahhab Mian and Justice M Emdadul Huq directed the government to release SQ Chowdhury if he is not wanted in any other case.
Army-led joint forces arrested SQ Chowdhury on February 4 in its crackdown on suspected corrupt politicians, businessmen and influential persons.
Later, he was sent to jail on a 30-day detention under the Special Powers Act.
AD-INTERIM ANTICIPATORY BAIL OF MONJU, AMINUL REJECTED
The High Court yesterday turned down the plea for ad-interim anticipatory bail for former ministers Anwar Hossain Monju and Barrister Aminul Huq but restrained law-enforcers from arresting the two former ministers “without due process of law”.
As both are put on the second list of corruption suspects published by the Anti-Corruption Commission, they surrendered before the High Court and prayed for bail. The court gave the direction following separate petitions filed by them.
The petitioners, who were on the run, moved the higher court for remedy apprehending arrest by the army-led joint forces as many a listed politicians, businessmen and influential persons have been thrown behind bars.
A division bench, comprising Justice Shah AN Mominur Rahman and Justice Abdul Awal, passed the orders.
Barrister Rafique-ul Huq appeared for the petitioners.
