Khaleda may sue NBR on tax issue

BNP Chairperson Khaleda Zia may sue the National Board of Revenue (NBR) if it ultimately declines to accept the tax on undeclared money.
Meanwhile, a writ petition is likely to be filed with the High Court today challenging the legality of the Anti-Corruption Commission (ACC) notice issued to detained former prime minister Sheikh Hasina for submitting her wealth statement.

On July 31, Khaleda Zia through her representative deposited about Tk 33.87 lakh with Bangladesh Bank as tax on her undisclosed Tk 1.33 crore.

NBR Chairman Badiur Rahman on Wednesday told reporters that they would not legalise Khaleda’s undeclared money, as she did not pay the tax as per rules in NBR’s prescribed form. He pointed out that Khaleda did not submit the income-tax return in paying the tax.

When asked whether his client would file case if the NBR ultimately does not accept the tax paid by his client, Ahmed Aazam Khan, Khaleda’s lawyer, told UNB, “This is an inevitable consequence.”

On the other hand, Barrister Fazle Noor Tapash, lawyer for former prime minister Sheikh Hasina, said they will initiate a legal process if they do not get the reply from the ACC by the deadline, 10:00am today.

Replying to a question, he told the UNB, “A writ petition with the High Court challenging the legality of the notice may be filed tomorrow (Sunday).”

To a query, Barrister Tapash said the ACC did not communicate with him after receiving the legal notice on Wednesday.

On Wednesday, Hasina sent a legal notice to the ACC through her lawyer, questioning the legality of the notice directing her to submit wealth statement.

Her legal notice asked the commission to reply by Sunday (today) at 10:00am, failing which legal actions will be taken.

It was claimed in the legal notice that a deputy director of the commission cannot issue such a notice to a former prime minister, rather the commission itself should have done that.
