A Dhaka court yesterday did not receive the bail petition of detained former prime minister Khaleda Zia in a graft case filed with Tejgaon Police Station on September 2.
Chief Metropolitan Magistrate Jalal Ahmed declined to accept the petition for hearing, saying that he had no jurisdiction to pass any order on the bail petition of a graft case.
In the petition, the defence lawyers mentioned that the government had filed the case against Khaleda, her younger son Arafat Rahman Koko and 11 others under sections 409/109 of the Bangladesh Penal Code and section 5(2) of the Prevention of Corruption Act.
But the case is yet to be brought under the Emergency Power Rules, even though there is a proposal from the home ministry submitted on September 3. So, there was no bar in granting bail to their client, the lawyers added.
On September 2, the Anti-Corruption Commission (ACC) had filed its first graft case against Khaleda, Koko and 11 others. Following the case, the law enforcement agencies arrested Khaleda and Koko from their Cantonment residence.
Later, Khaleda was sent to a sub-jail at the Jatiya Sangsad Bhaban Complex after she was produced before the Chief Metropolitan Magistrate’s Court, Dhaka.
They have been charged with breaching tender conditions in appointing Global Agro Trade (Private) Company Ltd (GATCO), an indenting house, for container handling at the Dhaka Inland Container Depot (ICD) and the restricted area at the Chittagong Port ICD yard although the company was lacking in experience and skills.
In the case filed by ACC Deputy Director Golam Shahriar Chowdhury, it was alleged that the former prime minister and her son influenced the tendering process and the CPA officials helped GATCO win the tender although a three-member tender evaluation committee of the port termed the company unfit for the work.
