Arrest warrant against PW for skipping court

A Sylhet court yesterday afternoon issued arrest warrants against prosecution witnesses of the murder case filed in connection with the grenade attack on British High Commissioner Anwar Choudhury for failing to appear before the court.

The witnesses also include a UNO, police officials and physicians. The judge will record deposition of the rest of the prosecution witnesses on November 27 and 28, court sources said.

Speedy Trial Tribunal Judge of Sylhet Division Dipyoman Sarker recorded the deposition of first class magistrate Devjit Sinha, now executive magistrate, before issuing the arrest warrants. Devjit told the judge he as a magistrate had recorded the confessional statements of the accused on May 31.

With this, 44 out of 57 prosecution witnesses’ statements were recorded, court sources said. The Sylhet Divisional Speedy Tribunal Judge started recording prosecution witnesses’ depositions on August 26.

The accused Harkat ul Jihad (Huji) chief Mufti Abdul Hannan, his brother Mofizur Rahman alias Muhibullah and Huji operative Sharif Shahedul Alam alias Bipul were placed before the court during the proceedings.

Arrest warrants were issued against Assistant Sub-inspector of Sylhet Kotwali Police Station Abdul Awal Chowdhury, Registrar of the Orthopaedic unit of Sylhet MAG Osmani Medical College Hospital Md Kamrul Alam, Magistrate, currently UNO of Baniachang, Habiganj, Nurey Alam Siddiqui, Metropolitan Magistrate of Dhaka Shafique Anwar, Assistant Registrar of Surgery unit of Osmani Medical College Hospital Matiar Rahman, Sub-inspector Yunus Miah and Sub-inspector Sabiur Rahman of Sylhet Kotwali, Md Abul Kalam Azad of 1557 Purba Nandipara, Khilgaon, Dhaka, former senior ASP of CID, Dhaka and investigation officer of the case Munshi Atiqur Rahman, the then Officer-in-charge of Sylhet Kotwali SA Newazi, Inspector of Detective Branch, Sylhet Shafiqul Alam, Detective Branch officer-in-charge Watch of Sylhet Shah Alam and Aziz Ahmed, son of Asmat Ali of Suranandi under Muradnagar upazila of Comilla.

Talking to The Daily Star, the Special Public Prosecutor of the Speedy Trial Tribunal Fokhoruddin Ahmed yesterday said even after repeated summons of the court, a number of prosecution witnesses did not show up in the recent months.

The court was compelled to issue arrest warrants against 13 prosecution witnesses, he said. Besides, the charge sheet also contained a number of flaws, including incomplete and incorrect addresses of the witnesses.

The Bangladesh-born British high commissioner and 70 others were hurt in the grenade attack while three were killed on May 21, 2004 on the Hajrat Shahjalal (RA) shrine premises in Sylhet.
