SC lawyers observe 2-hr work abstention

The Supreme Court Bar Association (SCBA) yesterday observed a two-hour work abstention at the Appellate Division, protesting some recent judgments of the apex court.

The state law officers including Attorney General (AG) barrister Fida M Kamal and a group of lawyers led by former vice-chairman of Bar Council Khondker Mahbub Hossain however attended the court proceedings during the SCBA programme that began at 9:00am.

The full-bench Appellate Division headed by Chief Justice Ruhul Amin sat at 9:30am and carried out their judicial function as usual. They heard 25 out of 36 cases on the cause-list for yesterday.

Speaking to newsmen at his office room, SCBA President barrister Shafique Ahmed said the programme was observed peacefully and spontaneously. Lawyers stayed off the Appellate Division for two hours as per the association’s decision.

He said those who represent the government and the Anti-Corruption Commission (ACC) however went about their business as usual.

“Besides, Khondker Mahbub Hossain, who lost the SCBA election last month, and a few lawyers, most of who are not enrolled for the Appellate Division, attended the court to satisfy certain quarters. After investigation, disciplinary action will be taken against them for violating the SCBA decision,” he said.

Barrister Shafique said the SC lawyers would continue their movement in order to establish rule of law and rights enshrined in the constitution.

He said the association will decide on its next course of action in consultation with the senior lawyers.

Meanwhile, Khondker Mahbub Hossain claimed the general lawyers have rejected the ‘undemocratic court boycott programme’ called by the SCBA president.

“The law will take its own course. The lawyers don’t support any court boycott. Especially when there’s a campaign for establishing democracy and rooting out corruption is on, they won’t allow this sort of undemocratic programme,” he said.

Mahbub said Shafique Ahmed is a lawyer for Awami League (AL) President Sheikh Hasina and facing defeat in cases at the Appellate Division, and so he has been out to create chaos in the judiciary by exploiting the SCBA as a platform.

Leaders of 11 lawyer organisations including Bangladesh Muktijoddha Ainjibi Parishad, Ain Pesha Parishad, Ainjibi Samonnoy Parishad and Ainjibi Durniti Protirodh Committee in a joint statement yesterday congratulated the lawyers for “rejecting the SCBA’s court boycott”.

The statement signed by Kamrul Islam Sajal said in the name of court boycott different attempts were made in the past to create anarchy and indiscipline on the court premises and damage the image of the judiciary.

The lawyers now are very conscious, and they won’t allow such undemocratic activities to take place again. If anyone feels aggrieved at any judgment of the court, he or she can file a review petition. No redress can be gained through court boycott and vandalism, read the statement.

Earlier, at an urgent general meeting on May 11, the SCBA decided to observe work abstention at the Appellate Division from 9:00am to 11:00am yesterday. Its Secretary Nurul Islam Sujan Wednesday sent a letter to the chief justice’s office to inform him of the decision.
