Parole might be cancelled any time: govt

The government notification ordering temporary release of detained Awami League (AL) President Sheikh Hasina yesterday said that the parole granted to the former prime minister might be cancelled any time without showing any reason.

The notification, signed by deputy secretary of the home ministry Md Mizanur Rahman, was issued at around noon following a meeting of IG Prisons Brig Gen Md Zakir Hasan with Home Adviser Maj Gen (retd) MA Matin at the Secretariat.

“Following recommendations of a medical board, the government has released former prime minister Sheikh Hasina Wajed on parole for eight weeks starting from June 11 as per the Section 401 (4A) of the Code of Criminal Procedure (CrPC), 1898,” the notification read.

The notification has been issued as per the directive of the president, it said.

As per the sub-section 4A, provisions of the previous sub-sections shall apply to any order passed by a criminal court under any section of this code of any other law, which restricts the liberty of any person or imposes any liability upon him or his property.

The sub-section 1 says that government may at any time without conditions or upon conditions suspend sentence of a person for an offence or remit the whole or any part of it while the sub-section 3 states the suspension or remission may be cancelled if any condition is not fulfilled in the opinion of the government and the person may be arrested without warrant and remanded to undergo the unexpired portion of the sentence.

The notification said that the courts concerned exempted Hasina from appearing at the court in person during hearing of the under-trial cases against her as per the Section 540 of the CrPC.

Inspector General (IG) of Prisons and the senior super of the Dhaka Central Jail have been asked to immediately execute the order of the parole issued in favour of Hasina. They have also been directed to report to the home ministry about the date and time of her temporary release.

“I have received the order. She will be given parole for eight weeks,” IG Prisons Zakir told reporters after his meeting with the home adviser when asked about Hasina’s release.

About imposition of any condition on Hasina, the prison boss said, “There will be only one condition, which is, the order of the parole may be cancelled at any time without showing any cause.”

Replying to a question, the IG Prisons said that he could not say if Hasina would be allowed to give political statements. “Police will take charge of her after she is freed.”

Zakir declined to comment on the release of another detained former prime minister and BNP chairperson Khaleda Zia and her detained younger son Arafat Rahman Koko.

“The medical boards formed for them have given recommendations for their better treatment. We will act only if the government issues an order in this regard.”

Zakir also failed to say if the parole of Hasina would be extended. “This is purely a matter of the government,” he added.
