Bijoy Sarani-Tejgaon link road stuck in court battle

Rajdhani Unnayan Kartripakkha (Rajuk) is likely to miss the deadline of December 16 for completing the Bijoy Sarani-Tejgaon Link Road as it is now unable to demolish five buildings on the land of the road for legal tangles.

Owners of five buildings, acquired by the Deputy Commissioner’s (DC) office, have filed cases against Rajuk with the High Court recently on grounds of being offered less money than they deserve as compensation for the acquired land and structures and a few other factors, said Abdul Hai, member secretary of the affected building owners’ association of Bijoy Sarani-Tejgaon Link Road.

Owners of 17 structures including six buildings, which were acquired, said they are yet to receive compensations for their land and structures.

Of the 17 structures, 10 tin-built structures have already been demolished, he added.

“We met Deputy Commissioner of Dhaka Kamal Uddin in this regard Monday and he told us that the process of compensating for acquired land and structures is going on excluding the owners who are in the legal battle,” Abdul Hai said.

“We filed the case on April 21 against the DC office and Rajuk as the DC office made an estimate of Tk 65 lakh compensation for our five-storied building at 119/6 Tejkunipara. They said it is brick-built but the building is actually made of RCC [Reinforced Cement Concrete] pillars,” said Humayun Kabir, son of the building owner Firoza Khatun.

The court has also stayed for six months the demolish work of the five-storey building that belongs to Monoreja Akand, Abdul Hai added.

A total of 24 structures were acquired to construct the 2400-foot-long and 60-foot wide road from Bijoy Sarani to Tejgaon, connecting the Old Airport Road at Bijoy Sarani and Tajuddin Ahmed Sarani at Nabisco intersection in Tejgaon, said a Rajuk official.

The Executive Committee of the National Economic Council in late August, 2007 approved the project for the road costing Tk 122 crore.

“We are hoping to complete the construction work by November but it is dependent on the demolition of the buildings that are on the road,” said managing director of Bhuiyan Engineering Ltd who got the work order for constructing the road.

“We started our work about a month ago and we are now setting up pipes for the drainage system which will be under the pavement of the road,” he said.

The firm on March 25 received the Tk 3.80-crore work order to construct the road and it has to finish the job in six months from starting, said a Rajuk official.

Rajuk on June 24 gave a work order to the joint-venture firm of RP and Udayan to construct an overpass at Tejgaon Level Crossing with an estimated cost of Tk 39 crore, the official said.

The firm has started their job and will take six months to complete, he said.

Apart from the buildings which are in the legal battle with the DC office and Rajuk, the demolition of other buildings is going on, the Rajuk official requesting not to be named said.

The demolition of the 22-storey Rangs Bhaban that started August 3, 2007, is going on and floors above 11th floor have been demolished, said the official Thursday.

“We hope to complete the demolition work of Rangs Bhaban by December,” he said.

Rajuk in the first week of November, 2007 demolished 44 illegal structures built on the land of the proposed road.

An official of Rajuk said they received documents regarding 3.75 acres of land and structures built on the land of the road from the DC office on March 13 as the city planner gave the DC office Tk 42.83 crore on February 27 as estimated cost of the land and structures.
